None of the Above
What we need is a binding "none of the above" option on the ballot. If "None of the Above" gets a plurality, the office will remain vacant until a special election is held. No candidate beaten by "None of the Above" will be allowed to re-enter the race for that election cycle.
Florida showed us that even a non-binding "none of the above" would be helpful. At least ballots would be clearly marked and no candidate can file a lawsuit claiming that all abstentions really meant to vote for him. Interesting argument though. Concisely, it could be reduced to:
- My opponent's supporters were all able to understand the instructions and he got all the votes to which he was entitled.
- My supporters were confused by the difficulty of the butterfly ballot and made errors giving some of my votes to him or not voting at all.
It certainly shows the filer's opion of his constituency.
